Terms of Service — Pulsehaven

By downloading or using Pulsehaven you agree to these Terms. If you do not agree, do not use the App.

1. The service

Pulsehaven estimates heart rate and heart-rate variability from your phone camera and presents personal-baseline comparisons, trends, and optional guided breathing. It is a consumer wellness tool, not a medical device, and is provided for general informational purposes only (see the Health Disclaimer). The App's measurements are not clinically validated and have not been reviewed, cleared, or approved as a medical device by any regulatory authority (including the U.S. Food and Drug Administration).

2. Eligibility

You must be at least 16 years old, or the age of digital consent in your country, to use the App.

3. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial use, subject to these Terms and the applicable app-store terms.

4. Acceptable use

You agree not to reverse engineer (except where permitted by mandatory law), resell, or use the App to provide medical diagnosis or advice to others.

5. Free version and Pulsehaven Plus

The free version includes unlimited quick heart-rate checks, one successful 60-second heart-rate and HRV measurement per local calendar day, the most recent seven calendar days of history, breathing, and context tagging. Failed or incomplete measurements do not use the daily 60-second measurement allowance. "Pulsehaven Plus" unlocks unlimited 60-second heart-rate and HRV measurements, personal-baseline reports, before-and-after recovery experiments, full history and trends, and weekly correlation insights.

5.1 Subscriptions and introductory offers

Plus is offered as an auto-renewing annual subscription or an auto-renewing monthly subscription. Prices and any introductory free-trial offer are shown by the app store before purchase and may vary by region, eligibility, and time. A trial is available only when the app store confirms that the account is eligible.

5.2 Auto-renewal terms

• The subscription renews automatically at the end of each term unless cancelled at least 24 hours before the term ends.
• Your account is charged for renewal within 24 hours before the end of the current term, at the then-current price for that plan.
• You can manage or cancel the subscription in your Google Play (or Apple App Store) account settings. Cancellation takes effect at the end of the current paid period; you keep access until then. We do not charge silent or hidden fees.
• We send a reminder before renewal where the platform supports it.

5.3 Refunds

Purchases are handled by the app store; refunds are governed by the store's policy and your statutory rights (which, in jurisdictions such as the EU/UK, may include a withdrawal right). We do not impose refund terms more restrictive than the store or the law.

6. No medical use

You acknowledge the readings are estimates and must not be used to diagnose, screen for, monitor, treat, or make decisions about any disease or medical condition. The App does not measure blood pressure, blood oxygen (SpO₂), body temperature, or electrocardiogram (ECG) data, and does not detect arrhythmia. See the Health Disclaimer, which forms part of these Terms.

7. Disclaimers and liability

The App is provided "as is" and "as available" to the extent permitted by law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (including for death or personal injury caused by negligence, for fraud, or for your statutory consumer rights). Subject to that, our total aggregate liability arising out of or relating to the App shall not exceed the amount you paid us, if any, for the App in the twelve months before the event giving rise to the claim.

8. Changes and termination

We may update the App and these Terms; material changes will be notified in-app. You may stop using the App at any time. We may suspend access for breach of these Terms.

9. Governing law

These Terms are governed by the laws of the People's Republic of China, without prejudice to mandatory consumer-protection rights in your country of residence.
